These Terms of Use govern your access to and use of MovingSpot.

MovingSpot is operated by IRD (Inoca Research And Development), Brussels, Belgium.

By creating an account and accepting these Terms, you agree to these Terms and the MovingSpot Community Guidelines.

If you do not agree, you must not use MovingSpot.

1. About MovingSpot

MovingSpot helps users discover places and events, see what is happening around them, share the current vibe of a place, check in and interact with other users.

Most information is created by MovingSpot users. Event or place information may also be provided by organisers, venues or other sources MovingSpot is legally allowed to use.

MovingSpot does not organise or operate an event simply because it appears in the app.

2. Your account

You are responsible for activity performed through your account.

You must not:

• impersonate another person;
• use MovingSpot for fraudulent or abusive purposes;
• attempt to access another user's account;
• misuse MovingSpot or its security systems.

3. User-generated content

MovingSpot allows users to contribute content including events, places, chat messages, photos, videos, presence information and vibe information.

You are responsible for the content you submit. You may submit content only if you created it yourself or have the necessary permission, licence or other legal right to use and share it.

This includes event descriptions, photographs, flyers, artwork, logos, text and other copyrighted or otherwise protected material. Do not copy or reproduce protected material from another website, platform or source unless you are authorised to use it.

You retain ownership of your content.

By submitting content, you confirm that you have the necessary rights and grant IRD a limited, non-exclusive licence to host, store, process, technically reproduce, display, distribute within MovingSpot, moderate and remove that content where necessary to operate the service.

4. Unacceptable content and behaviour

You must not use MovingSpot to publish, promote or facilitate:

• harassment or bullying;
• threats or violence;
• hateful or discriminatory content;
• sexual exploitation or non-consensual sexual content;
• child sexual abuse or exploitation;
• illegal activity;
• fraud or scams;
• spam;
• impersonation;
• deliberately false or misleading event or place information;
• disclosure of another person's private information without permission;
• content that infringes another person's rights;
• malicious links or attempts to compromise the service.

The Community Guidelines form part of these Terms.

5. Events and places

Users can create events and places.

MovingSpot may also display event or place information provided by organisers, venues or other sources MovingSpot is legally allowed to use.

Dates, locations, prices, availability and other event information may change. MovingSpot cannot guarantee that every listing is complete or up to date.

MovingSpot does not sell tickets or process ticket payments.

Links to tickets or other third-party services may take you outside MovingSpot.

6. Presence and vibe

MovingSpot allows users to voluntarily indicate their presence at a place and contribute information about its current atmosphere.

Other users may see that you are currently present at a particular place.

Your device's precise GPS coordinates are not displayed to other users as your check-in location.

Presence and vibe information is temporary and should not be relied upon for emergency or safety-critical decisions.

7. Chat

MovingSpot provides chat associated with active places.

Users may share text, photos and short videos.

Chat content is temporary and may disappear when the relevant place no longer has active presence.

Chat content must comply with these Terms and the Community Guidelines.

8. Reporting

You can report a chat message using the reporting functionality available in the app if you believe it violates these Terms or the Community Guidelines.

You can report an event or other content through the in-app Feedback feature or by contacting [email protected].

IRD may investigate reports and complaints. Authorised moderators may dismiss a report or remove or restrict content where appropriate.

Submitting a report does not automatically mean that the content will be removed.

Misuse of reporting tools may itself be considered abusive behaviour.

9. Blocking

MovingSpot allows you to block another user.

While either person blocks the other:

• each person cannot see the other's venue-chat messages, including chat media, reactions, active presence or user-created events;
• user-originated chat or message, presence or check-in, and event-created notifications are suppressed in both directions.

The other person's pseudonym and avatar remain visible in the Network member directory, but without active presence. Other users can still see their user-created events. Events not created by that user, Places, and protected aggregate or historical statistics remain visible or unchanged.

The blocked user is not directly notified that you blocked them.

Each person controls only their own block. A block is removed when its owner unblocks or when either associated account is permanently deleted. Direct content becomes visible again only after neither person blocks the other.

10. Moderation and enforcement

IRD may remove, restrict or moderate content where it reasonably believes that the content violates these Terms or the Community Guidelines, infringes third-party intellectual-property rights, is unlawful, abusive or unsafe, or otherwise creates a legitimate moderation concern.

Repeated or serious violations may result in content removal or account termination where reasonably necessary to protect users, protect the service, address serious abuse or comply with applicable law.

IRD does not pre-approve or independently verify all user-submitted content.

11. Child safety

MovingSpot has zero tolerance for child sexual abuse and exploitation.

Child sexual abuse material, grooming, sextortion, sexual exploitation of minors and similar behaviour are prohibited.

12. Location

MovingSpot may request access to your device location when you actively use location-based features.

MovingSpot does not continuously track your location in the background for these features.

Location permissions can be controlled through your device settings.

13. External services

MovingSpot uses technical service providers where necessary to operate the service.

MovingSpot may also provide links to external services.

Those services may have their own terms and privacy policies.

14. Account deletion

You can initiate permanent account deletion directly from your MovingSpot profile.

In certain situations, assistance from support may be required to complete deletion.

15. Service availability

We aim to keep MovingSpot available and reliable, but uninterrupted or error-free operation cannot be guaranteed.

Features may evolve, be added, modified or removed.

16. Intellectual property

The MovingSpot name, branding, software, interface and original content are protected by applicable intellectual property laws.

These Terms do not transfer ownership of MovingSpot intellectual property to users.

If you believe content available through MovingSpot infringes your intellectual-property rights, contact [email protected]. Please provide enough information to identify the content concerned, the rights you believe are affected and the basis for your request so that IRD can review it.

17. Changes to these Terms

We may update these Terms as MovingSpot evolves or when necessary for legal, safety or platform requirements.

If a material update requires renewed acceptance, we may ask you to accept the updated Terms before continuing to use relevant features.

18. Applicable law

These Terms are governed by Belgian law, without limiting mandatory rights that may apply under the law of your country of residence.
